Surprisingly the rip off version has shown more variation in gameplay and more of what can be done in the game than NMS has shown in the last 3 years...

Ok but saying a clone is gong to get sued is like sayingg all those tetris clones are copies of tetris. They are clones only in the sense they took a bit of inspiration but have slightly modified the game enough to not be exact carbon copy of the thing.
If lego can rip off minecraft with lego worlds then why can't Planet Nomads rip off no man's sky? Just add twists to make it different enough. Like how the recent movie revenant was inspired by the dreamcast.
You see dreamcast swirly logos in the movie. Sega hasn't sued. ^about the 3:50 mark you see the ancient dreamcast logo used (the makers of the movie must be secret fans of the DC which was an underdog console that struggled to survive like the main character in the movie)
