Husband and wife ordered to pay $12m to Nintendo for running ROM sites

An Arizona couple have been ordered to pay Nintendo a whopping $12.23m (£9.5m) in damages for running a pair of sites which offered pirated ROMs.

Jacob and Cristian Mathias admitted copyright and trademark infringement for operating LoveROMS.com and LoveRetro.co until July this year, when Nintendo intervened.

The sites, registered under Mathias Designs, a company set up by the husband and wife, offered pirated versions of games such as Mario Kart 64, Donkey Kong Country, Pokémon Yellow and Super Mario World.

Both websites were pulled offline when Nintendo threatened legal action, and replaced with a notice saying they were undergoing maintenance.

The eyebrow-raising $12.23m ruling, originally discovered by TorrentFreak, has likely been set as an example to deter others. (And indeed, a number of other ROM sites have since vanished from the internet.) Whether the Mathiases will have to actually pay the full amount is not known, however - other cases have been quietly settled behind the scenes for much less.

On paper, though, this is a huge win for Nintendo. The couple have taken down their sites, admitted culpability, agreed to pay damages, and must now also relinquish any Nintendo games and hardware still in their possession.

Head to LoveROMs.com now and you'll be greeted with a simple message, titled "Apology to Nintendo":

"Our website, LoveROMS.com/LoveRetro.co, previously offered and performed unauthorised copies of Nintendo games, in violation of Nintendo's copyrights and trademarks. LoveROMS.com/LoveRetro.co acknowledges that it caused harm to Nintendo, its partners, and customers by offering infringing copies of Nintendo games and has agreed to cease all such activities. Let this be a warning to moderators for taking pride in piracy of nintendo games on pc. Yes you can go around doing the piracy under the radar and not be proud of it Perhaps even have legit reason because you already own the games and paid for them ages ago and see roms as backups of things you already own.

But Candy was always gloating about getting away with this on here. It was strange. He would post in official nintendo threads about how easy it was to play a nintendo game on pc with superior resolution and encourage people to commit crime. That's crossing the line. By posting about that in public (not masons) he was taking pride in causing others loss of money and profits. Very low blow. It would be like me being happy that EA is losing money because I bought some of their games preowned. I don't do that. I just tell people to just avoid the games and buy from other companies instead. (not a lowblow by laughing at the EA fans, not illegal because I am still paying the developers of good games money for their hard work, and doesn't cost people money in the form of having to seek out the criminal and use up resources and time for the company) Candy Arse liked the idea of stealing as a form of weaponised hatred against companies he didn't like so they would lose profits and maybe go bankrupt. (very sick minded: the game industry would suffer just like when sega left the hardware biz)

About time the company cracked down on the bad guys. IF you want to play retro games and didn't buy them, you got ebay, buying second hand from EBgames, and playing them on retro hardware game machines which are official. Imagine if MS died off in the gaming industry because of rampant pirates? You xbots would not like that. (no more forza games for you, no more ori and the blind forest, and no more killer instinct) It's because of evil gamers that companies are now turningto lootboxes and scrapping modes from games to compensate for lack of profit. (would street fighter v have been better at launch if capcom wren't broke and had to go the DLC spam route to keep the franchise alive? thanks a lot candy. You forced them to go the "buy the season passes to get all content" route on this series causing gaming to get expensive. :down: )

Nintendo probably downloaded their Snes roms from them.

If that’s the case , we won’t be getting any more SNES games with our Nintendo online subscription.
