Ive been reading latley that the Unreal 3 engine doesnt support aa on xbox 360, how is this so when all games require a min 2xaa as a part of the microsoft certification process?

It doesn't support the tiled rendering process that the Xbox 360 uses to get 2xAA "for free". They could enable 2xAA but they would take a performance hit.
